LeadFi Terms and Conditions

Momentum Mastery LLC, d/b/a LeadFi, operates the website LeadFi.ai and provides access to its services, software, and products under the following Terms and Conditions. By using LeadFi’s services, you agree to these Terms, forming a binding contract between you and Momentum Mastery LLC. Please read these Terms carefully as they include important information about your rights, including binding arbitration and disclaimers.

1. Overview and Acceptance of Terms

These Terms govern your use of LeadFi’s financial evaluation and lead processing services (the “Services”) provided by Momentum Mastery LLC. By accessing the Website or Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

2. Website Use and Conduct

You agree to use LeadFi for lawful purposes, in compliance with all applicable laws. We grant you a limited, revocable, non-transferable license to use the Website and Services. Unauthorized use will result in termination and legal action.

3. Privacy Policy and Data Collection

4. Personal Information and Consent

LeadFi collects and processes financial data for clients under applicable credit reporting laws such as FCRA. Clients must obtain explicit consent from users before collecting or processing their financial information, including credit scores.

5. Payment Terms and Fees

LeadFi charges an annual licensing fee of $5,000 and $3 per processed lead. All payments are non-refundable and processed automatically via ACH or credit card. Non-payment may result in termination.

6. Refund Policy

All sales are final due to the nature of LeadFi’s services. Once access to the Services has been provided or data processing has begun, refunds will not be issued. Clients are encouraged to review all service details before purchase.

7. Subscription Terms and Automatic Payments

Subscription services are automatically billed annually. To cancel, clients must provide written notice at least 10 days before the next billing cycle. LeadFi reserves the right to terminate services for unpaid balances or non-compliance with these Terms.

8. Limitation of Liability

LeadFi is not responsible for any damages, direct or indirect, arising from the use or inability to use our Services. Liability is limited to the amount paid for the Services in the preceding 12 months. Some jurisdictions do not allow limitation of liability; in such cases, liability is limited to the extent permitted by law.

9. Service Availability and Changes

LeadFi makes no warranties that the Services will be uninterrupted or error-free. We reserve the right to modify, suspend, or discontinue the Services at any time without notice.

10. Client Responsibilities

Clients are responsible for complying with all applicable laws, including obtaining user consent for financial evaluations and complying with regulations like CCPA, GDPR, and FCRA. LeadFi provides tools but is not liable for misuse or non-compliance by clients.

11. Consent to E-Signatures

By agreeing to these Terms, clients consent to the use of electronic signatures and records for all transactions and communications. Clients may request paper copies, but ongoing use of LeadFi requires electronic consent.

12. Intellectual Property

LeadFi content, including text, logos, and software, is owned by Momentum Mastery LLC and is protected by U.S. and international intellectual property laws. You are granted a limited license to use the content for business purposes related to LeadFi. Unauthorized use will result in termination and potential legal action.

13. Confidentiality and Non-Circumvention

Clients agree not to engage in any activities designed to circumvent LeadFi’s services or business model. Violating this clause will result in termination and legal action to recover damages.

14. Compliance with Data Protection Laws

Clients must ensure they meet all legal obligations related to data privacy, including complying with laws like CCPA, GDPR, and FCRA. LeadFi’s Services help evaluate financial viability, but clients are responsible for their own privacy compliance, especially regarding user consent.

15. Disclaimers of Warranties

LeadFi is provided “as is” without any warranties, including warranties of merchantability or fitness for a particular purpose. We make no guarantees regarding the accuracy or reliability of the Services.

16. Termination of Services

LeadFi may terminate access to Services if clients breach these Terms or fail to make timely payments. Upon termination, any unpaid fees remain due, and all client data will be securely deleted unless required for compliance.

17. Governing Law and Venue

These Terms are governed by the laws of Wyoming, and any disputes will be settled in the courts of Sheridan, Wyoming.

18. Force Majeure

LeadFi is not liable for delays or failures caused by factors beyond our reasonable control, including natural disasters, acts of war, or technical failures.

19. Amendments to Terms

LeadFi reserves the right to amend these Terms at any time. Changes take effect immediately upon posting. Continued use of the Services after changes indicates acceptance.

20. Assignment

Momentum Mastery LLC may assign its rights under these Terms to a third party. Clients may not assign their rights without written consent.

21. Dispute Resolution and Arbitration

Disputes will be resolved through binding arbitration in Sheridan, Wyoming under the rules of the American Arbitration Association. Class action lawsuits are waived.

22. Marketing and Lead Generation Disclaimer

LeadFi provides financial evaluation tools, but clients are responsible for lead generation, marketing strategies, and conversions. LeadFi does not guarantee lead conversion rates or business growth.

23. Notices and Communications

LeadFi will communicate electronically with clients, including email and Website notifications. Clients are responsible for maintaining updated contact information and checking communications regularly.

24. Client Participation Requirement

Client participation is essential for effective use of LeadFi’s services. Failure to engage with the Services may result in cancellation without refund.

25. Delays in Service Fulfillment

Delays in fulfilling services may occur due to client failure to provide necessary information. LeadFi reserves the right to extend deadlines under these circumstances.

26. Intellectual Property Ownership

All improvements, derivative works, and intellectual property developed by clients using LeadFi tools shall be owned by Momentum Mastery LLC. Clients agree to assign ownership of any such developments.

27. Digital Signature and Consent

Clients agree that digital signatures and consent are legally binding under these Terms. This agreement constitutes the entire contract between LeadFi and the client, superseding all previous agreements.

28. Regulatory Compliance

LeadFi adheres to relevant regulatory guidelines, including the FCRA, GDPR, CCPA, and any other applicable local or international laws. Clients must ensure that their own business practices align with these standards.

29. Refunds and Exceptions

Refund requests due to LeadFi’s non-performance will be considered on a case-by-case basis, but generally, all sales are final due to the digital nature of the services provided.

30. Data Security and Encryption

LeadFi utilizes industry-standard encryption and security protocols to protect client data. Clients are responsible for ensuring the security of any data shared through LeadFi’s platform.

31. Electronic Communications Agreement

By using LeadFi, you consent to receiving electronic communications regarding your account and services. These communications are considered legally binding and may replace paper records.

32. Independent Contractor

Nothing in this agreement creates an employer-employee relationship between Momentum Mastery LLC and its clients. LeadFi operates as an independent contractor for all purposes.

33. No Waiver

Failure by LeadFi to enforce any right or provision of these Terms does not constitute a waiver of future enforcement of that right or provision.

34. Severability

If any provision of these Terms is deemed unenforceable, the remaining provisions will remain in full effect.

35. Entire Agreement

These Terms, along with any referenced policies, constitute the entire agreement between you and Momentum Mastery LLC regarding LeadFi. Any modifications to this agreement must be made in writing.

LeadFi SMS Terms
  1. LeadFi provides business coaching, consulting and educational services. We use SMS to announce new events or trainings, send reminders of scheduled appointments and provide critical client information regarding their accounts.
  2. You can cancel the SMS service at any time. Simply text “STOP” to the shortcode. Upon sending “STOP,” we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.
  3. If you experience issues with the messaging program, reply with the keyword HELP for more assistance, or reach out directly to support@leadfi.ai
  4. Carriers are not liable for delayed or undelivered messages.
  5. As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.
